BY USING TESS, YOU CONSENT TO THE COLLECTION, USE, AND SHARING OF YOUR INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY, INCLUDING OUR USE OF COOKIES AND SIMILAR TRACKING TECHNOLOGIES. IF YOU DO NOT AGREE WITH OUR PRACTICES, PLEASE DO NOT USE THE SERVICE.

Payment Information:

We do not directly collect payment information. Payments are processed by Spiffy, our third-party payment provider. Please review Spiffy's privacy policy for information about how they handle payment data.

Content You Create:

• Scripts, hooks, and captions generated using our Service
• Product search queries
• Favorites and folder organization preferences

2.2 Information Collected Automatically

Usage Data:

• Pages visited and features used
• Search queries submitted
• Time spent on the Service

Analytics Data:

2.3 Information from Third-Party Services

TikTok Shop Data (via TikTok Shop Affiliate API):

When you link with our agency through the TikTok Shop Partner Center, we access your data through the following TikTok Shop Affiliate API endpoints:

Creator Marketplace Data (via Search Creator and Get Marketplace Creator Performance endpoints):

• TikTok username, display name, and profile avatar
• Bio/description and region/location
• Follower count and performance metrics
• Audience demographics (age, gender, geographic distribution)

Performance Metrics:

• Gross Merchandise Value (GMV) - total, by video, by livestream
• Units sold and sales ranges
• Commission rates and earnings
• GPM (GMV per mille) - overall, video, and livestream
• Video performance (views, likes, comments, shares, engagement rates)
• Livestream performance metrics
• Category and brand GMV distribution

Campaign & Product Data (via Campaign Performance endpoints):

• Products you're promoting in agency campaigns
• Product-level sales, commissions, and creator collaboration metrics
• Individual video/livestream performance for campaign products
• Sample fulfillment and shipping status

Reference Data (via Categories and Brands endpoints):

• Category names for GMV breakdown display
• Brand names for collaboration statistics

Note: Some TikTok data fields require your explicit permission at the TikTok level (such as precise units_sold, gmv, and avg_commission_rate values). If you have not granted certain permissions to TikTok, that data will either be absent or shown as a range instead of a precise value.

2.4 Information from Mobile Devices

If you access TESS through a mobile application, we may collect additional information including:

Device Information:

• Device model and manufacturer
• Operating system version
• Unique device identifiers
• Mobile network information

Mobile Permissions:

Our mobile app may request access to certain device features. You can manage these permissions through your device settings:

• Camera: Used for scanning product barcodes or capturing product images for search
• Photo Library: Used for selecting images for product search or content creation
• Push Notifications: Used to send you updates about sync status, new features, or important account information
• Storage: Used to cache data for offline access and improve app performance

All mobile permissions are optional. You can use the core features of TESS without granting these permissions, though some features may be limited.

3. How We Use Your Information

3.1 To Provide and Maintain the Service

• Save and organize your created content

3.3 Aggregate Analytics for Service Improvement

We may analyze aggregated, anonymized data across our user base to:

• Identify performance benchmarks for our agency members
• Improve our training and educational content
• Optimize platform features and user experience

Important: This aggregated analysis is conducted solely to improve the Partner Services we provide to you and other members, in accordance with TikTok's Partner Terms of Service. We do not use TikTok data for any purposes outside of providing services to our agency members. We do not sell aggregated data to third parties.

• Notify you of changes to our Terms or Privacy Policy

4. How We Share Your Information

4.1 We Do NOT Share Individual Creator Data with Other Users

Your TikTok Shop performance data is visible only to you. We do not display one creator's data to another creator. Each user can only see their own statistics.

4.2 Service Providers

We share information with third-party service providers who assist us in operating the Service:

These providers are contractually obligated to protect your information and use it only for the purposes we specify.

Note on TikTok Data: TikTok Shop performance data is NOT shared with AI services or product data providers. These services only receive product search queries and user-generated content requests. TikTok data is stored only in our primary database and is displayed directly to the user who owns that data.

4.3 Legal Requirements

We may disclose your information if required to do so by law or in response to valid legal requests (e.g., court orders, subpoenas).

4.4 Business Transfers

If we are involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change.

4.5 With Your Consent

We may share your information with third parties when you explicitly consent to such sharing.

5. Data Retention

5.1 Account Data

We retain your account information for as long as your account is active. If you cancel your subscription or request account deletion, we will delete or anonymize your data within 30 days, except as required by law.

5.2 TikTok Performance Data

• Profile statistics: Retained for up to 90 days for historical trend analysis
• Video data: Retained while your account is active; deleted upon account deletion
• Daily snapshots: Retained for trend analysis; deleted after 90 days

5.3 Usage Logs

• Server logs: Retained for 30 days
• Analytics data: Retained according to each provider's retention policy

5.4 Content You Create

Scripts, hooks, and captions you create are retained until you delete them or your account is terminated.

6. Data Security

6.1 Technical Safeguards

We implement industry-standard security measures including:

• Encryption in Transit: All data transmitted between your browser and our servers is encrypted using TLS 1.3
• Encryption at Rest: Database is encrypted at rest; TikTok OAuth tokens are encrypted using AES-256-GCM
• Authentication: Secure authentication via Clerk with support for multi-factor authentication
• Access Controls: Role-based access controls limit employee access to user data

6.2 Security Limitations

While we strive to protect your information, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security.

7. Your Privacy Rights

7.1 Access and Portability

You have the right to:

• View your TikTok statistics at any time through the Service

7.2 Correction

You may update your account information through the Service settings or by contacting us.

7.3 Deletion

7.4 Disconnection

You may disconnect your TikTok account from TESS at any time through the Settings page. This will stop new data collection from TikTok.

TikTok Shop performance data displayed in TESS is obtained through the TikTok Shop Affiliate API in compliance with TikTok's terms and policies. We use the following API capabilities:

• seller.creator_marketplace.read - For creator search and performance data
• partner.tap_campaign.read - For campaign, product, and content statistics
• partner.authorization.info - For retrieving authorized category assets
• product.read - For category and brand name lookups

11.3 Data Use Restrictions

In accordance with TikTok's requirements, we:

• Only access data you have authorized us to access through agency linkage
• Use TikTok data solely to provide Partner Services to you
• Do not sell TikTok data to third parties
• Do not use TikTok data to create profiles for advertising purposes
• Do not share individual creator data between users

TESS uses artificial intelligence (AI) services to provide product search, content generation, and analytics features. Information you provide (such as search queries and content requests) may be processed by AI systems to generate responses. We do not use your TikTok performance data to train AI models. AI-generated content is provided for informational purposes and should be reviewed before use.
